Police Insist No Court Order Stops Tinted Glass Permit Enforcement

The Nigeria Police Force has said it has not been formally served with any court judgment or order directing it to suspend the enforcement of the motor vehicle tinted glass permit policy.

The Force Public Relations Officer, CSP Benjamin Hundeyin, said on Friday that the police only became aware of the reported court decision through media reports and had not received any official court processes.

His statement followed reports that a Delta State High Court had issued an ex parte injunction restraining the Inspector-General of Police and the Nigeria Police Force from resuming enforcement of the policy nationwide.

According to Hundeyin, the police would review the judgment with its legal advisers and comply with any lawful directive once it is properly served.

Police Question Legal Process Behind Order

Hundeyin explained that the Force is already a party to multiple pending cases on the same subject before the Federal High Court, adding that it has not been served with any fresh filings in the Delta State matter reportedly instituted by lawyer Olukunle Edun (SAN).

He said the police are aware, through media coverage, that a new suit may have been filed at the Delta State High Court despite the existence of earlier cases still awaiting determination.

“The Nigeria Police Force has not been served with any processes in respect of this alleged action. Upon service, the Force will examine the matter with its legal advisers and take all lawful steps available,” Hundeyin said.

The tinted glass permit enforcement was resumed earlier this month after being suspended in October, prompting renewed public debate and legal challenges.

Force Defends Policy Against NBA Criticism

Responding to criticism from the Nigerian Bar Association, Hundeyin rejected claims that the policy is arbitrary or designed to generate revenue, insisting it is firmly rooted in existing law and public safety considerations.

He said the Motor Vehicles (Prohibition of Tinted Glass) Act, 2004, enacted by the National Assembly, gives the Inspector-General of Police the authority to issue permits where applicants can show legitimate security or health-related needs.

Hundeyin also dismissed allegations that payments linked to the permit were made into private accounts, explaining that Parkway Projects Limited is a Central Bank of Nigeria-licensed payment service provider engaged to process payments in line with government procedures.

He clarified that the earlier suspension of enforcement followed consultations with stakeholders, including the NBA, and was not the result of any court order.

The police maintained that enforcement of the policy would continue unless and until a valid court order is properly served on the Force.
